easyjet hat heute kurzfristig unseren Rückflug IOM - LGW am 16.07. annuliert.

Angeboten wird eine Umbuchung, ein Voucher oder die Erstattung des Flugpreises.

Fällt hier nicht auch eine Entschädigung gem. EU261 an, da die Stornierung unter 14 Tagen vor Abflug liegt?

Losgelöst von der Frage der weiteren Anwendbarkeit auf das UK ist die Isle of Man von jeher vom Anwendungsbereich der VO 261/04 ausgenommen (da kein Teil des UK):

"2.1. Territorial scope
2.1.1. Geographical scope
Article 3(1) of the Regulation limits its scope to passengers departing from an airport located in the territory of
a Member State to which the Treaty applies and to passengers departing from an airport located in a third country to an
airport situated in the territory of a Member State to which the Treaty applies if the operating air carrier is an EU
carrier.
According to Article 355 of the Treaty on the Functioning of the European Union (TFEU), EU law does not apply to the
countries and territories listed in Annex II to the TFEU (16). Instead, those countries and territories are subject to the
special association arrangements laid down in accordance with Part Four of the TFEU. Moreover, it does not apply to
the Faeroe Islands, the Isle of Man and the Channel Islands according to the act of accession of Denmark and the United
Kingdom. Therefore, these territories are to be considered as third countries within the meaning of the Regulation (17)."

Die Antwort macht absolut keinen Sinn, da EU-Verordnung - hier geht es aber um die UK261. Und daher steht, wegen UK Airline, Entschaedigung zu - egal ob IOM oder nicht!

Ja, sorry, es fehlte das zugehörige Zitat. Ich bezog mich auf die Feststellung, dass das UK nicht mehr in der EU sei. Die Isle of Man war von jeher Drittstaat, so dass die Frage der Entschädigung den Drittstaatregeln folgt.

Selbst dann wäre es jeher eine Fluggesellschaft der Gemeinschaft gewesen.
