As a result of recent guidance, many categories of travel that provides a substantial economic benefit to the U.S. economy are eligible for a National Interest Exception (NIE) to the Presidential Proclamation on Suspension of Entry for Nonimmigrants and Certain Additional Persons Who Pose a Risk of Transmitting 2019 Novel Coronavirus (PPNCOV). This includes, but is not limited to:
•
Investors: Travel in connection with investment or trade in the U.S. economy that generates a substantial economic impact, including investors and treaty-traders on E-visas and the senior-level employees who provide strategic direction or expertise essential to the success of the investment, and their dependents.
•
Technical experts and
specialists to install, service, maintain, or receive training for vessels, machinery and other specialized equipment used by U.S. and foreign firms with a substantial investment in the United States. Travel is temporary in nature and for a defined period of time.
•
Senior-level managers and
executives, and their dependents, who provide strategic direction necessary for the success of the company or venture.
Please see the attached for more information about the NIE itself. If you or your employees wish to request a NIE, please read, complete, and return it to us via email (visa holders) or at the visa interview (prospective applicants).
For business/economic cases (e.g. B1/B2, ESTA) please provide us with the documentation listed below. We ask that you forward us the requested documentation in one email even if you previously already submitted parts of this documentation as we are otherwise not able to process this request for a NIE. If you have several employees/clients in line who would like to travel within the next 30 days, please send us a consolidated file.
- Copy of the visa/ESTA travel authorization
- Signed NIE Compliance Statement
- Company letter explaining the project or enterprise in the U.S., a summary of what each of the travelers will be doing when they are there, why no U.S. worker can perform the work they will do, and how long each traveler will remain in the U.S. The letter should detail the importance and urgency of the company’s need for the travelers in U.S, including, for example, the products the company will make that may be in the “national interest,” revenues, U.S. employees or jobs created, and any other helpful background.
- Resume or CV of the workers/technicians
- A separate letter from German company sending the travelers emphasizing its expertise, value to the project, and any other details about the focus of the employees it intends to send to the U.S. will strengthen the case.
We ask that you refrain from returning this NIE to us if you already requested a NIE with the U.S. Embassy Berlin or the U.S. Consulate Munich.
You will be informed as soon as the NIE has been approved.
If approved, the national interest exception will only be valid for 30 days and one entry. Frequent travelers must therefore apply for an NIE prior each trip. If your travel dates are more than 30 days away, please wait to submit your documents until your dates are within the 30-day window.
The U.S. Consulate General-Frankfurt has resumed limited routine visa operations. Due to our continued priority of providing services to U.S. Citizens and COVID-19 restrictions, the number and type of visa appointments available will be limited. The B1/B2 visa category is currently not available for applicants through their online profile at
www.ustraveldocs.com thus these applicants should submit an emergency appointment request by sending an email to
FrankfurtVisaInquiries@state.gov including a letter justifying the urgent travel.
