Our jurisdiction extends only as far as the definition of “air transportation” in 49 USC 40102, which, roughly paraphrased, is “transportation as a common carrier by air for compensation between points in different states, between points within a US territory, or between a point in the US and a point outside the US”. Even if a ticket is bought in the US, if the transportation does not involve at least one leg that falls under this definition, DOT has no jurisdiction and DOT cannot take enforcement action based on the federal air travel consumer protection laws and regulations. However, in a situation where a ticket is bought in the US, but we do not have jurisdiction, the Federal Trade Commission or state or local consumer protection agencies likely do have jurisdiction.
